1. Acceptance of Terms

By accessing or using Pierre Review ("the Service"), operated by Noah Brown ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Pierre Review provides legislative tracking, analytics, and related data for the South Dakota Legislature. The Service includes both free and paid subscription tiers ("Pierre Review Premium").

3. Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use.

4. Subscriptions and Payment

Pierre Review Premium is offered as an annual subscription. Subscription fees are billed at the start of each billing period and are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. You may cancel your subscription at any time; access continues through the end of the current billing period.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, crawl, or automatically collect data from the Service without written permission
• Attempt to gain unauthorized access to any part of the Service
• Redistribute premium content to non-subscribers
• Interfere with or disrupt the Service's infrastructure

6. Data Accuracy

Legislative data is sourced from third-party providers including LegiScan and the South Dakota Legislature. AI-generated summaries and vote forecasts are estimates and may contain errors. The Service is provided for informational purposes only and should not be relied upon as legal or political advice. We make reasonable efforts to ensure accuracy but do not guarantee it.

7. Intellectual Property

The Service's design, code, analytics methodology, and original content are owned by us. Legislative data sourced from public records remains in the public domain. You may share links to the Service freely. You may not reproduce substantial portions of premium content without permission.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any data will be accurate or complete.

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may close your account at any time by contacting us. Upon termination, your right to use premium features ceases immediately.

11. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of South Dakota. Any disputes shall be resolved in the state or federal courts located in South Dakota.
