South Dakota businesses must now clearly disclose at the start of any customer interaction if the consumer is communicating with an artificial intelligence chatbot or computer program rather than a human, so consumers aren't deceived into thinking they're talking to a real person. Businesses that fail to provide this notice can be sued by consumers or the state's attorney general for actual damages, a flat $1,000 penalty per violation, or up to $10 million in a class action lawsuit, plus attorney's fees.
