This bill strengthens South Dakota's groundwater protection rules by prohibiting new groundwater permits if annual withdrawals would exceed the amount of water naturally replenished each year to that source. The bill makes a narrow exception allowing water distribution systems to exceed annual recharge rates only when withdrawing from very deep, ancient groundwater formations below the Greenhorn Formation.
